  1. Scope

These Terms of Service apply to purchases made through our online store. Mandatory consumer rights under the law applicable to the customer remain unaffected.

  1. Products

Product images and colours may appear slightly different depending on lighting, screen settings and the made-to-order production process.

The essential product characteristics, available sizes and current price are displayed on the relevant product page. Customers are responsible for selecting the correct size and delivery information before ordering.

  1. Prices and payment

Prices are displayed in the currency selected in the store. Shipping costs and any taxes collected by us are shown before the customer submits the order.

Payment is due when the order is placed. Available payment methods are displayed at checkout.

  1. Orders and contract formation

By submitting an order, the customer makes a binding offer to purchase the selected products. A contract is concluded when we send the order confirmation by email.

Customers can review and correct their order details before submitting the order. We may cancel an order if payment fails, the product is unavailable or the order cannot lawfully be fulfilled. Any payment already received for a cancelled order will be refunded.

  1. Made-to-order fulfilment

Products are produced after an order is placed and may be fulfilled and shipped directly by a third-party production partner. Offerta Clothing remains the customer’s contractual seller and point of contact.

  1. Shipping and delivery

Production times, estimated delivery periods, shipping charges and information about possible import charges are explained in our Shipping Policy.

  1. Returns and defects

Withdrawal, returns and refunds are governed by our Return and Refund Policy.

Mandatory rights concerning defective, incorrect or non-conforming goods remain unaffected. EU consumers benefit from the applicable statutory legal guarantee, including a minimum two-year legal guarantee where required by law.

  1. Intellectual property

The Offerta Clothing name, original designs, photographs, graphics and website content may not be reproduced, distributed or commercially used without prior written permission, except where permitted by law.

  1. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, intentional misconduct, gross negligence, personal injury or mandatory consumer rights.

We are not responsible for losses caused solely by incorrect information provided by the customer or circumstances outside our reasonable control, subject to mandatory law.

  1. Privacy

Personal data is processed according to our Privacy Policy.

  1. Governing law

These Terms are governed by Swiss law. This choice of law does not deprive consumers of mandatory protections provided by the law of their country of residence.

Any dispute will be handled by the courts determined under mandatory applicable law.
